This document tells you the terms and conditions of the services and information listed on our website auctions.cheekytrip.com. Please read these terms and conditions carefully before making use of any services and information on our site. You should understand by using the services and information provided on our site that you agree to be bound by these terms and conditions.

We will contact you by writing to you at the email address or postal address you provided to us.

Registration

By using the website and/or by creating an account on the website (your “account”), you confirm that;

  • You are capable of entering a legally binding contract
  • You are 18 years old or older. (Proof of age may be required if you win an auction)
  • You can make payments with either a credit card or debit card
  • You are not an employee of HDC Travel Limited
  • You are not acting on behalf of a commercial organisation or a reseller

Each user is only permitted to create one account per email address. We may terminate or suspend access to our website if we find the user has created more than one account. We will also terminate your account if you breach any of the below;

  • Breached any laws or rights of third parties
  • Used or attempted to use any third party bidding software
  • Used any false or misleading information during registration or the amendment of details
  • Colluded or attempted to collude with other users in order to win an auction
  • Created an account as an employee of HDC Travel Limited

When an account is suspended due to an investigation of a potential breach as above, we reserve the right to freeze all activity on the account, including but not limited to placing bids, claiming goods or services won. When an account is reinstated any goods or services won will then be awarded to the user.

When an account is terminated any goods or services won but not yet provided will not be awarded to the user. We may report any criminal activity that may have been committed during any such abuse of your account. We generally hold the user to whom the account belongs responsible for any activities undertaken using the account. We accept no liability whatsoever for any losses incurred or caused by any unauthorised use of your account. Upon termination your right to use the service will immediately cease.

Do not disclose your password. Accounts are non-transferable. You are responsible for safeguarding your password that you use to access the website and for any activities or actions under your password. You agree not to disclose your password to any third party or to permit the access to your account by any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.

By registering with Cheekytrip Auctions you agree to join our mailing list so we can email you with our latest holiday offers, auction reminders and general information.

Cheekytrip Auctions has the right to contact the winner after the end of an auction and to publish information about the winner however you can opt out of this in your preferences.

How Auctions Work with Cheekytrip

Bidding;

Once users have created and logged in to their account they will be able to bid on our live auctions.

Max Bids

We are now adding an auto bid feature to certain auctions. Simply enter the maximum amount you are willing to pay for the item and we'll then bid in increments on your behalf to keep you in the lead. We will never go over your limit, and will not bid if you are leading the auction. Only bid what you are willing to pay otherwise you will be liable for the auction if you win.

Winning Bid;

The highest bid, defined as the person to bid a certain amount in a given auction, and that amount being the highest amount bid in that auction. The auction and bidding processes are set out in more detail on the how it works section of our website.

Bid Status;

When you place a bid you will see a message regarding the status of your bid. The message will confirm if your bid is the highest bid or not the highest bid. The status of your bid may be affected by the bids of other users. It is your responsibility to check the status of your bid. Notwithstanding, in the event that your bid was the highest bid and it subsequently loses its status as the highest bid, you will be notified by email.

Process of the Auction;

Upon expiry of the auction, the winner, being the person with the highest bid at expiry, is then verified.

Tie Break;

In the rare event of a tie-break and there is no highest bid the first person to bid that amount is the winner.

Events which may affect an Auction;

We reserve the right to:

  • Suspend or terminate an auction at any time in the event of technical problems or to make minor technical changes or to investigate suspected irregular or fraudulent activity
  • Limit the auctions you may participate in
  • Terminate an auction if in our opinion it does not benefit our users and has not had sufficient interest

We will contact you in advance to tell you we will be suspending the supply of the goods or services, unless the problem is urgent or an emergency. You may contact us to end the contract for any goods or services if we suspend them or tell you we are going to suspend.

Winners are announced automatically on the ‘Winners’ section and will be contacted immediately. We allow 7 working days for the winner to contact Cheekytrip Auctions by return email. Failure to make contact within 7 working days means the auction lot is then offered to the next highest bidder.

Disqualification can also take place if you break the rules of the auction and fraudulent activity will be reported.

We reserve the right to disqualify bidders who create more than one account on Cheekytrip Auctions website as this is fraudulent activity.

Cheekytrip Auctions are unable to retract any bids that have been confirmed in an auction as the site is tamper proof and all bids are recorded as sealed bids.

Our Products

Products may vary slightly from their pictures. The images of the goods and services on the website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the goods or services. Your goods or services may vary slightly from those images.

Our service may contain links to third party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services. We strongly advise that you read the terms and conditions and privacy policies of any third party websites or services that you visit.

The website may contain goods and services provided by third parties. We cannot confirm that the information supplied by such third parties is correct or accurate and we are not liable for the goods and services themselves.

Providing the Goods & Services

We will let you know when we will provide the goods or services to you when we notify you that you have placed the highest bid. However, goods or services will only be confirmed to you once we have received payment in full.

If Product is to be Delivered;

  • Postage is only available to UK residents only.
  • Any costs of delivery will be as displayed to you in the relevant auction on our website
  • We will let you know when we will provide the goods or services to you at the time of notification to you that you have placed the highest bid in respect of those goods or services
  • goods or services will only be delivered to you once we have received payment in full
  • If our supply of any products or services is delayed by an event outside our control then we will contact you as soon as possible to let you know
  • We will not be liable for delays caused but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products or services you have paid for but not received
  • If no one is available at your address to take delivery and any goods cannot be posted through your letterbox, a note will be left informing you of how to rearrange delivery or collect the goods
  • If you do not collect the goods from us as arranged or if, after a failed delivery to you, you do not re-arrange delivery or collect goods we will contact you for further instructions and may charge you for reasonable storage costs and any further delivery costs
  • We are not responsible for delays outside our control
  • If you do not allow us access to your property to perform any services as arranged (and you do not have a good reason for this) we may charge you reasonable additional costs incurred by us as a result
  • A product which consists of goods will be your responsibility from the time we deliver the product to the address you gave us, or you (or a carrier organised by you) collect it from us
  • You own a product which consists of goods once we have received payment in full

We may need certain information from you so that we can supply the goods or services to you. If so, we will contact you to ask for this information. If you do not give us this information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may end the contract. We will not be responsible for supplying the products late or not supplying any part of them if this is caused by you not giving us the information we need within a reasonable time of us asking for it.

Your Rights to End the Contract

Your rights when you end the contract will depend on what you have bought, whether there is anything wrong with it, how we are performing and when you decide to end the contract;

  • If what you have bought is faulty or miss sold you may have a right to end the contract
  • You want to end the contract because of something we have done or have told you we are going to do

If we determine that your goods have developed a fault within what we consider to be a reasonable time, we will arrange for the goods to be collected from you at our expense and a repaired or replacement item will be returned to you within a reasonable time, at our expense. Where we are unable to provide a repaired or replacement item, we reserve the right to issue a full refund of the purchase price. Where the goods appear to have been the subject of abuse, accidental damage or misuse, we reserve the right to refuse to provide a repaired or replacement item and to charge you for the cost of us collecting the item from you and returning the item to you.

If you are ending the contract for a reason set out below the contract will end immediately and we will refund you in full for any goods or services which have not been provided.

  • We have told you about an upcoming change to the goods or services
  • We have told you about an error in the price or description of the goods or services you have ordered
  • There is a risk that supply of the goods or services may be significantly delayed
  • We have suspended supply of the goods or services for technical reasons

If you end your contract and we are not at fault you may have to pay an administration or cancellation fee. A contract for goods is completed when the goods are delivered and paid for. A contract for services is completed when we have finished providing the services and you have paid for them.

How to End the contract

To end contracts with us please let us know by one of the following;

  • by email at auctions@cheekytrip.com
  • by post simply write to us and include details of what you bought, when you ordered or received it and your name and address

If you end the contract for any reason after goods or services have been dispatched to you or you have received them you must return them to us. You must pay the costs of returns unless product or services are faulty. We will refund you the price you paid for the goods and services by the method you used for payment. However, we may make deductions from the price if amendment or cancellation fees apply to travel related services. We will make any refunds due to you as soon as possible.

Our Right to End the Contract

We may end the contract for goods or services at any time by emailing you if;

  • You do not make any payment to us when it is due
  • You do not provide us with any information or documentation that is necessary for us to provide the products or services (within a reasonable time frame)
  • You do not allow us to deliver the products to you or collect them from us (within a reasonable time frame)
  • You do not allow us access to your premises to supply the services (within a reasonable time frame)
  • You provide inaccurate or incomplete information to us when creating an account
  • You do not comply with any other terms & conditions relating to the goods or services provided by a third party

Price & Payment

The price for the goods or services (including VAT) will be the price indicated on the bid pages when you placed your bid.

We accept payment with debit card or credit card. You must pay for the goods or services before we provide or deliver them to you.

If you think a price is wrong please contact us promptly to let us know.

Your Personal Information

As set out in our Privacy Policy, we will use the personal information you provide to us;

  • To supply the goods or services to you
  • To process your payment for the goods or services
  • If you agreed to this during the bid process, to give you information about similar goods or services that we provide, but you may stop receiving this at any time by contacting us.
